License terms
These terms apply to every photograph licensed from this site. They are written to be read, not to be endured.
Who grants the licence
Every photograph on this site is the work of Yves Paternoster, who is its author and remains the holder of the copyright in it. Licences are granted and invoiced by FASEO SRL, which is authorised to grant them on his behalf.
What you are buying
You are buying a licence: permission to use a photograph in a defined way. You are not buying the photograph, its copyright, or any ownership of it. Unless your licence says otherwise, it is non-exclusive — the same image may be licensed to others.
Your licence is personal to you or to your organisation. It cannot be transferred, resold or passed on, except to a client on whose behalf you commissioned the use, and then only for that use.
The licences
The scope of your licence is set by the option you choose. The written confirmation you receive at purchase is the authoritative record of what you may do.
- Personal
A print for your own wall, a personal project, a gift.
One person, non-commercial use only. Print up to A2. Unlimited duration, worldwide, non-exclusive. May not be resold, redistributed or used to promote anything.
- Web & social
Websites, blogs, social media, newsletters and presentations.
One company or organisation. Unlimited duration, worldwide, non-exclusive. Digital use only — no print, no advertising.
- Editorial
Press, magazines, books and articles.
Unlimited duration, worldwide, non-exclusive. Editorial context only — the image may not be used to promote a product or service. Delivered as JPEG and 16-bit TIFF.
- Commercial extended
Advertising, marketing, packaging, corporate presentations.
One company. All media, print and digital. Unlimited duration, worldwide, non-exclusive. Delivered as JPEG and 16-bit TIFF.
- Exclusive
The image is withdrawn from sale and licensed to you alone.
On request. Negotiated per project — duration, territory and scope are agreed case by case. From $2,500.
Licences are worldwide and, unless stated otherwise, unlimited in duration. If your intended use does not fit any of them, describe it — most requests can be accommodated. See the current fees.
What no licence allows
- Reselling, sublicensing or redistributing the file, on its own or as part of a stock library.
- Using the image in a way that is defamatory, or that suggests an endorsement that does not exist.
- Using the image in a pornographic, hateful or unlawful context.
- Registering the image, or any work derived from it, as a trademark.
- Using the image to train machine learning or generative models, or including it in a dataset assembled for that purpose, unless expressly agreed in writing.
Editing
You may crop, resize and adapt the image as your use requires. Substantial alterations that change the meaning of the photograph require prior agreement — the author's moral rights in the work remain his, and cannot be waived.
Credit
Editorial use requires a visible credit reading “© Yves Paternoster”. Credit is welcome, but not required, for other uses.
Exclusivity
Exclusive licences are granted on request only, so that it can be confirmed beforehand that the photograph has not already been licensed to someone else. An exclusive photograph is withdrawn from sale for the agreed period, and its scope, duration and territory are set out in the written agreement.
What you receive
A high-resolution file, delivered as a download, together with a written licence stating the photograph, the permitted use, the duration and the territory. Keep it: it is your proof of the right to use the image.
Files carry the photographer's copyright information in their metadata, and each delivered file is individually marked. Please do not strip that information — under Belgian and European law, removing rights management information from a protected work is itself an infringement.
If a licence is exceeded
A licence used outside its agreed scope is void, and continued use of the image then constitutes copyright infringement. Where a use has simply outgrown its licence, the usual outcome is an upgrade, agreed amicably — say so and it will be arranged.
