Terms of sale
These terms govern the purchase of a licence through this site. What you may then do with the photograph is described separately, in the license terms.
The seller
Licences are sold and invoiced by FASEO SRL, 10 rue Alphonse Collin, 1330 Rixensart, Belgique, VAT BE 0772.673.591. Full details are in the legal notice.
What is sold
What is sold is a licence: the right to use a photograph in a defined way, together with the high-resolution file needed to exercise it. The photograph itself, its copyright and its authorship are not sold and remain with Yves Paternoster.
No physical goods are supplied. Nothing is printed, packed or shipped.
Prices and taxes
Prices are shown in USD and are exclusive of value added tax. Where tax applies it is calculated and shown before payment, and appears on the invoice.
- Customers outside the European Union pay no European VAT.
- Businesses inside the European Union holding a valid VAT number are invoiced without VAT under the reverse charge mechanism, provided that number is supplied at the time of purchase and can be verified.
- Belgian customers, and private individuals in the European Union, are charged Belgian VAT.
Prices may change at any time. The price that applies is the one displayed when the order is placed.
Placing an order
An order is placed by choosing a photograph and the licence that matches the intended use, then completing payment. The sale is concluded when payment is confirmed. A confirmation and an invoice are then sent by email.
Exclusive licences, and uses that no published licence covers, are not sold directly: they are agreed in writing beforehand. Ask through the contact page.
Payment
Payment is by credit or debit card, handled by our payment provider. Card details are entered on the provider's own secure page and are never received, seen or stored by us.
The licence takes effect only once payment has been received in full.
Delivery
The file is delivered as a download, immediately after payment, through a personal link sent by email. The link stays valid for a limited period and for a limited number of downloads — long enough to download the file comfortably, short enough that it cannot be passed around. Keep a copy of the file once downloaded; a fresh link can be requested if something goes wrong.
Files are supplied as a maximum-quality JPEG in sRGB. Editorial and commercial licences also include a 16-bit TIFF. Camera raw files are never supplied.
Right of withdrawal
A consumer in the European Union normally has fourteen days to withdraw from a distance purchase. That right does not survive the immediate delivery of digital content: by asking for the file to be made available at once, and by confirming that request at the moment of payment, you expressly consent to immediate delivery and acknowledge that you thereby lose your right of withdrawal.
Until you give that confirmation, the file is not released and your right of withdrawal is untouched.
If something is wrong
If the file is corrupt, does not open, or is not the photograph or the licence you ordered, say so and it will be corrected or refunded in full. This applies for a reasonable period after purchase, and legal guarantees of conformity apply in any event.
Beyond those cases, a delivered licence is not refundable — the file cannot be returned once it has been supplied.
Liability
The photographs are supplied as artistic works. It is for the buyer to check that the intended use is lawful in its own context — in particular where recognisable people, private property, trademarks or protected buildings appear in an image. No model release or property release is supplied unless expressly stated in writing.
Nothing in these terms limits liability for death, personal injury, fraud, or any liability that cannot lawfully be excluded.
Personal data
The data collected in order to sell a licence — name, email address, billing details and, where applicable, VAT number — is used to process the order, issue the invoice, deliver the file and keep the accounting records required by law. It is not sold and not used for anything else. To ask what is held, or to have it corrected or erased, get in touch.
Governing law and disputes
These terms are governed by Belgian law. Where a consumer resident in the European Union is involved, the mandatory consumer protection rules of their country of residence continue to apply.
In the event of a disagreement, the first step is to write to us — most things are settled that way. A consumer who is not satisfied with the outcome may bring the matter before the Belgian Consumer Mediation Service before going to court. Failing agreement, the courts of Belgium have jurisdiction.
